Under Florida law, intelligence and credibility are both established criteria in determining whether a minor can get an abortion without parental consent.
A low GPA demonstrates a below-average intelligence. The court can deny an abortion because the child is deemed “lacking the maturity” to make a decision that is “complex” but at the same time, the court believes they are mature enough to have and raise a child.
The decision to abort a fetus is deemed more complex than the act of being pregnant for 9 months, multiple visits to a doctor to calculate procedures and medication, giving birth, watching over a newborn, and then raising a human to maturity.
